Halls Lake Update
On October 7, 2024 our Opposition to the SRA License of Occupancy Team after months of investigations and research, contacted our two local Councilors, Sabrina Richards and Lisa Barry and invited them to meet and discuss our preliminary investigative results in a respectful and informative meeting. Councilor Richards responded for both, unfortunately declining our request upon citing legal advice regarding the current litigation underway by the Maple Lake Residents, who are also opposed to this By-Law.
Mayor Danielsen, upon hearing of our request, did responded back stating that, “Council has always contended that there may be anomalies in the process which they are prepared to address”, and that our road has been pointed out as one that might have to be considered based upon the relevant information we have investigated. The Mayor also stated that in a month or two, once the outcome of the litigation is known it will help us all go forward in our talks.
It was unfortunate that in the haste to have this resolved by our Mayor and Council in a 3 to 2 vote, passed this By-Law, which in our opinion is based upon what we consider some questionable legal and liability concerns and seems to lacks any justifiable detail to support their position. In all fairness to our two councilors, they did not support the By-Law as presented at the time.
Those residents who followed the Council meeting back in late 2023 when this By-Law was proposed, effectively heard the Mayor call us all freeloaders, stating, “I hate to sound hard nose, but people have been enjoying the use of our property, nothing that belongs to them at all for decades at no cost. But to put everyone else in the municipality at risk isn’t right.”
Nothing is further from the truth as our research will eventually show.
Our Research Covered
- Analysis of the history of Hall’s Lake Road regarding facts and surveys
- Researched and analyzed the Ontario Land Registry documents for Stanhope Township related to Concession 9 and 10, Lots 11,12,13,14,15 along Hall’s Lake Road
- Requested and obtaining Crown Patent documents for property along the road
- Researched the earliest homesteaders and landowners on Halls Lake
- Researched Stanhope Township history and the Halls Lake settlement back to the 1800’s and early 1900’s
- Investigated the original land survey details from circa 1860 by the Crown, Government of Canada that established the legally recognized concession and lot boundaries for Stanhope Township along with the original shoreline and the 66 foot shoreline road allowance around Halls Lake
- Investigated and researched the origin and timing of the Halls Lake Dam
- Investigated the legal definitions of Forced and Travelled Roads along with the Municipality Highway Act
- Completed survey to accurately estimate the original shoreline markers of circa 1860 along Hall’s Lake Road to establish the Townships legal limits to their ownership claim of land beyond the original shoreline road allowance
- Investigated past and recent shoreline property transactions
- Sent out recently HCVoices flyer to all affected properties
Details of our research and results will be shared at the appropriate time when the Township is ready to have a meaningful two way discussion.
